Drugged driving involves the use of illegal (or illicit) and legal (prescription or over-the-counter) drugs. It presents a serious threat to the safety of Texas motorists. Driving under the influence of any drug that acts on the brain could impair one’s motor skills, reaction time and judgment, the National Institute on Drug Abuse (NIDA) says. Drugged driving puts not only the driver at risk but also passengers, pedestrians and others who share the road. The 2009 National Survey on Drug Use and Health (NSDUH) said an estimated 10.5 million people reported driving under the influence of illegal drugs during the year prior to the survey
​The National Highway Traffic Safety Administration (NHTSA) found in a 2009 study that, among fatally injured drivers, 18 percent tested positive for at least one drug (e.g., illicit, prescription, or over-the-counter). That marked an increase from 13 percent in 2005. The NHTSA’s 2007 National Roadside Survey found that more than 16 percent of weekend, nighttime drivers tested positive for illegal, prescription or over-the-counter medications. More than 11 percent tested positive for illicit drugs.
​While drunk driving gets most of the attention in driving-impaired accidents, drugged driving presents the same risks and hazard to public safety. According to the NHSTA, about 22% of drivers have at some point driven while under the influence of some mind-altering substance. Some of these drivers were using illegal substances like cocaine, heroin or LSD while others were on prescription drugs or over the counter medications that can alter their mental state.
​It is important to understand the effects of taking medications and be aware of how any prescription drug affects you prior to operating any type of machinery or vehicle. Many of the drivers who find themselves liable for drugged driving were taking medications prescribed to them. They underestimated the impact that the drug had on their ability to safely operate a vehicle before injuring innocent people in the process.

Danger of Drugged Driving and Car Accidents

​Many medications cause drowsiness, affect depth perception, cause dizziness or reduce reaction time in a manner similar to alcohol. Street drugs have even more pronounced effects and there is no excuse for drivers who place others at risk by getting high and driving. What is most alarming, however, is that many drivers seem to be oblivious to how common medications impact their driving abilities. Almost half of the motorists tested for substances following an accident had some form of prescription medication in their systems. ​There is no standard measurement for drugged driving, such as the blood-alcohol content (BAC) test used to measure impairment in drunk drivers. While such test is in the works, it is still new and not quite implemented throughout the state effectively. Drugs do not appear in the system the same way alcohol does. Alcohol burns off relatively quickly, but some drugs can remain in the body for days or weeks after the initial ingestion and impairment. So, it is more difficult to get an accurate reading of the amount or type of drugs in a driver’s system and how they affect his or her motor abilities and/or cognition.
