​Currently, Texas does not have a motorcycle helmet law if you are over the age of 18. The nonexistence of this type of law in Texas has contributed to a contentious debate in the state. Those who oppose helmet laws do not believe that their liberty and freedom should be impeded by regulations, while those who support such laws advocate for the safety of all riders on the road.

• Statistics from the Texas Department of Transportation show that there were 501 motorcyclists (operators and passengers) killed in 2017. Fifty two percent (52%) of motorcyclists killed were not wearing helmets at the time of the crash.
• ​Motorcyclist deaths occurred 28 times more frequently than fatalities in other vehicles, based on 2016 fatal crash data. • ​​Motorcyclists are at Risk with 37% of motorcycle riders being killed in a single-vehicle crash which involved alcohol or and impaired driver in 2016.

​In 2011, the U.S. Department of Transportation National Highway Traffic Safety Administration reported that over 4,612 motorcyclists died as a result of traffic accidents. This number reflected a two percent increase from the number of cyclists who died in 2010. It is clear that motorcyclists are facing more risks to their lives than ever on the roads. This can be contributed to the lack of protection that a cyclist has while riding a motor bike compared to that of a passenger vehicle.

​The majority of fatal motorcycle crashes in 2011 occurred during normal working hours on Mondays through Fridays. This could account for the fact that some people rely on motorcycles or mopeds as a main form of transportation to their place of employment. While other drivers on the road may view motorcyclists as “free spirits” with perhaps nothing better to do than “joy ride,” the reality is that these cyclists often have similar work commitments and have the same rights on the road as other drivers.
